Nicholas P. Connon served
as lead class counsel for the proposed plaintiffs'
class in this class action lawsuit. The class action
sought injunctive relief and damages under the
Telephone Consumer Protection Act of 1991 ("TCPA")
against numerous defendants who were involved in the
unlawful practice of fax blasting unsolicited
advertisements to businesses and consumers in
California. The California Court of Appeal
issued a decision in favor of plaintiffs upholding
the right of plaintiffs to prosecute their class
action claims under the TCPA.
Kaufman v. ACS
Systems, Inc (2003) 110 Cal.App.4th 886, 2
Cal.Rptr.3d 296. The Kaufman decision is
one of the leading
appellate decision in California under the TCPA, and
one of the leading decisions in the nation.
Settlement/Implementation Completed. This case
was settled. Implementation
of the settlement has been completed and this case
has been fully resolved and dismissed.
