Nicholas Connon has litigated numerous cases involving
Section 425.16 of the California Code of Civil Procedure,
known as the SLAPP statute. The SLAPP statute was designed
to allow early disposition of abusive claims that have no
merit and that arise out of protected activities, such as a
person's free speech rights or right to petition for
grievances in the courts. However, the SLAPP statute has
been invoked with increasing frequency in a variety of
contexts. In the Baum decision, which is unpublished, the
Court of Appeal affirmed the limitations of the SLAPP
statute and held that a compulsory cross-complaint for
misappropriation of trade secrets and other claims does not
fall within the purview of the SLAPP statute.
